Common Causes of Pedestrian Accidents

Getting to the bottom of why pedestrian accidents happen can prevent them from occurring in the future. It can also help you identify who may be legally at fault for your recent Las Vegas collision.

In our years serving pedestrian accident victims, we’ve come to recognize a few common reasons accidents tend to happen more than others.

This is not an exhaustive list, but it gives you an idea of frequent hazards pedestrians face on the Strip and elsewhere in Clark County:

  • Distracted drivers. Driver distraction has reached an unparalleled level thanks to cell phone and technology use behind the wheel. Distracted drivers may ignore traffic signs, fail to yield the right of way, and enter crosswalks without watching for pedestrians.
  • Negligent or reckless drivers. Other forms of driver negligence also put pedestrians at risk. Drunk driving, drowsy driving, speeding, and breaking roadway rules are all actions that could cause pedestrian injuries and deaths.
  • Property defects. Pedestrians aren’t only at risk of bad drivers – their surroundings may also present hazards. Construction zones, poor sidewalk maintenance, parking lot defects, and debris in walkways can contribute to pedestrian injuries in Las Vegas.

Whether a driver was texting and ran into you or an unsafe construction zone forced you to put your life at risk, contact our experienced Las Vegas pedestrian accident lawyers to discuss your case. No pedestrian should have to deal with his or her injuries without financial help – especially if someone could and should have prevented the collision.

Our accident lawyers can help you exercise your rights during insurance negotiations or a court trial.

What to Do if You are Hit By a Car as a Pedestrian?

Many pedestrians do not realize the importance of using the correct strategy after an accident in Las Vegas. Unfortunately, this can lead to pedestrian accident victims struggling to get insurance companies to offer them fair compensation. It is critical to take the right steps after an accident if you wish to protect your legal rights.

  1. Move out of the street, if you can.
  2. Keep the driver at the scene, even if you do not feel injured.
  3. Obtain the driver’s name, contact information and license plate number.
  4. Call the police for an official investigation and a police report.
  5. Give the police your side of the event.
  6. Get the names of eyewitnesses.
  7. Take plenty of photographs while still at the scene.
  8. Go to a hospital in Las Vegas immediately.
  9. Call the driver’s insurance company to start a claim.
  10. Contact a pedestrian accident attorney.

Contact Panish | Shea | Ravipudi LLP’s pedestrian accident lawyers in Las Vegas any time, day or night, to discuss a potential lawsuit. Who is Liable in a Pedestrian Accident?

Once you understand why your accident happened, you can name the appropriate defendant(s) to receive your civil claim.

Under Nevada’s fault-based system, the person who caused the accident will be liable for your damages. If it was a distracted driver, for example, the driver’s auto insurance plan should cover your damages.

All drivers in Nevada must carry at least $25,000 in bodily injury liability insurance per person and $50,000 per accident. This insurance should pay for your losses if the driver negligently or recklessly caused your pedestrian accident.

If your surroundings led to a vehicle striking you, however, the owner of the property could be liable. On private property, this could be the person who owns the road or sidewalk. On public property, the owner could be the city, state or county.

Going up against the government in Nevada is different than filing a claim against a private party. Nevada’s Tort Claims Act requires the injured party to file a written claim with the State Board of Examiners, for example. A lawyer can help you with this legal process. The party liable for your damages will be the one most at fault for causing your accident.

Elements of a Pedestrian Accident Claim

You or your legal team will need to prove liability through establishing the four elements of a personal injury claim: duty, breach of duty, causation and damages. Your legal team will need to prove this using evidence that the defendant owed you a legal duty, failed to fulfill this duty and caused your pedestrian accident.

Your attorney will also need to show proof of damages, often through medical bills and pay stubs. Understanding how pedestrian accident claims work in Nevada could give you an idea of what to expect during your lawsuit.

Common Injuries After a Pedestrian Accident

A pedestrian is one of the road users with the highest risk of suffering severe or fatal injuries in an accident, unlike motor vehicle drivers or cyclists, a pedestrian has no protection in an impact. Some of the most common injuries pedestrians could suffer in a car accident include:

  • Broken bones
  • Traumatic brain injury
  • Head and neck injuries
  • Spinal cord injuries
  • Soft tissue injuries
  • Death

Depending on the vehicle type, speed, and impact, a pedestrian could suffer mild or permanently debilitating injuries. If you or a loved one has been involved in a pedestrian accident, our lawyers can help an injured pedestrian recover compensation to cover for medical bills, lost wages, property damage, and even pain and suffering. Basic Las Vegas Pedestrian Rules and Laws

Drivers legally must respect the law and give you the space you need while walking or crossing. As a pedestrian, you also have responsibilities, such as knowing when you can and cannot cross the street.

Throughout Nevada, all drivers must yield to people walking crosswalks. This includes pedestrians crossing at an intersection, even if the intersection does not have pavement markers. If a traffic control signal says not to walk, however, drivers will have the right-of-way.

It is against the law for a pedestrian to jaywalk in Las Vegas. Jaywalking refers to crossing the street at a place in the road between two intersections.

The Strip in Las Vegas is no exception, people walking along The Strip cannot cross the street at places other than crosswalks and intersections. Doing so can result in a fine of up to $160, as well as a misdemeanor.

If you were jaywalking at the time of your collision, contact our lawyers to find out if you still have grounds for a claim. Comparative negligence may be a usable defense in your case, a Las Vegas pedestrian accident attorney will help you with the specifics of your case.

Most Common Places for Pedestrian Accidents in Las Vegas

Unfortunately, Clark County is a hot spot for pedestrian accidents, most of them occur in high transit areas where people using public transportation are rushing to get to their stop and may not notice oncoming traffic.

A distracted driver and a distracted pedestrian could both cause an accident. According to crash data from the Nevada Department of Transportation, some of the streets with the highest number of fatal pedestrian accidents include:

  • Flamingo Road
  • Sahara Avenue
  • Las Vegas Boulevard North
  • Charleston Boulevard
  • Boulder Highway
  • Lake Mead Boulevard
  • Durango Drive

Pedestrians and drivers should always be alert of their surroundings, drivers should yield to people at crosswalks and pedestrians should also follow traffic signals and road rules to prevent a serious accident.
