How Long Will My Orange County Bicycle Accident Case Take?

Orange County bicycle accident lawyer

We understand that you need to secure compensation for your damages as quickly as possible, and our Orange County bicycle accident attorneys work diligently to make that happen. How long it takes to resolve your bicycle accident case depends on many factors. Once we have thoroughly evaluated your claim and attempted to negotiate a fair settlement, we can provide you with an estimate of how long we believe your case will take.

The more severe your injuries and the longer it takes you to reach maximum medical improvement, the longer it generally takes to settle your claim. The length of your case is also impacted by how many parties are involved, how strong your case is, and whether the insurance companies are willing to negotiate in good faith to settle your claim.

The general timeline of an Orange County bicycle accident case includes the following stages:

  • Consult an experienced Orange County bicycle accident attorney to understand your rights and get your claim started. Notify the defendant’s insurance company of your intent to file a claim.
  • Follow the recovery plan implemented by your health care provider, including all therapies and procedures, until you have fully recovered or reached maximum medical improvement.
  • Your attorney will help determine all your economic and non-economic damages, including future damages. Depending on your injuries, your attorney may consult medical and financial experts to understand and accurately value past and future losses and expenses.
  • Filing a demand with the defendant’s insurance company. Once we know the value of your claim, we will send a demand letter with supporting documentation to the insurance company in a good faith attempt to resolve your case before having to file a lawsuit.
  • The insurance company will usually respond with a counteroffer, and negotiations begin. At Panish | Shea | Ravipudi LLP, our attorneys work hard to reach a fair settlement of your claim as quickly as possible.
  • If a fair settlement cannot be reached, we file a lawsuit and begin conducting formal discovery. During this time, negotiations often continue while working to prepare your case for trial.
  • At some point after a lawsuit is filed, the parties typically participate in a mediation with a mediator whom all parties agree to.  The goal of a mediation is to resolve your case for full and fair value.  If the insurance company is not interested in paying the full and fair value for a righteous case, we will proceed as though we are taking the case to trial.
  • When a trial is necessary, your case can take much longer, especially if the court’s docket is backlogged.

At all stages, our skilled Orange County bicycle accident attorneys work to help you collect maximum compensation as quickly as possible.

What Damages Can I Recover After a Bicycle Accident Case?

The type and amount of damages you can recover after an Orange County bicycle accident depend on many factors, including whether liability is disputed, the severity of your injuries, the strength of your case, and the available insurance coverage or other assets to pay your proven damages.

In a successful Orange County bicycle accident claim, you should be able to recover economic damages such as current and future lost wages, current and future medical expenses, and other financial losses and costs incurred due to your accident and injuries.

You may also be able to recover non-economic damages such as pain and suffering, mental and emotional distress, loss of enjoyment of life, scarring and disfigurement, and other intangible losses and costs incurred because of your accident and injuries.

In rare bicycle accident cases, you may be able to recover punitive damages. However, punitive damages, also known as exemplary damages, may only be awarded by a jury when you can prove by clear and convincing evidence that the defendant is guilty of malice, oppression, or fraud.

According to California Civil Code §3294(c):

  • “Malice” means conduct which is intended by the defendant to cause injury to the plaintiff or despicable conduct which is carried on by the defendant with a willful and conscious disregard of the rights or safety of others.
  • “Oppression” means despicable conduct that subjects a person to cruel and unjust hardship in conscious disregard of that person’s rights.
  • “Fraud” means an intentional misrepresentation, deceit, or concealment of a material fact known to the defendant with the intention on the part of the defendant of thereby depriving a person of property or legal rights or otherwise causing injury.”

If the defendant’s conduct was especially reckless or egregious, the court may award punitive damages. For example, if it is determined that the defendant’s intoxication while driving caused your damages, punitive damages may be appropriate. At Panish Shea Ravipudi, LLP, our attorneys work diligently to secure all forms of damages and maximum compensation for you.

Right-of-Way and Laws for Bicyclists In Orange County

Before riding in Orange County, you should be familiar with state and local cycling laws. If you have been injured in a bicycle accident in Orange County, you need to know how the relevant bicycle laws may impact your claim.

California Right of Way Laws

Bicyclists in California are given the same right-of-way protections as motor vehicle drivers, as outlined in California Vehicle Code Section 21200

For example, California Vehicle Code Section 21801 explains that, motor vehicle drivers at an intersection who are turning left, right, or intending to complete a U-turn, must yield the right of way to a cyclist proceeding straight through the intersection when the cyclist reaches the intersection first or is close enough to the intersection to constitute a hazard at any time during the turning movement.

Motor vehicle drivers must also yield the right of way to cyclists in bike lanes at all times. In fact, as outlined in California Vehicle Code Section 21209, drivers are prohibited from driving in or across a bike lane except to park legally, while entering or leaving a roadway, and when preparing for a turn within 200 feet of an intersection.

California’s Three Feet for Safety Rule

Under the Three Feet for Safety Act, as outlined in California Vehicle Code Section 21760, drivers must give cyclists at least three feet of clearance when passing. If there is not enough room to provide three feet, the driver must slow down and wait until it is safe to pass.

This law was created to protect bicyclists from some of the most dangerous collisions, including sideswipes and overtaking crashes, which often cause catastrophic injuries. When motorists ignore the Three Feet for Safety Rule, they put cyclists at unnecessary risk and may be held liable for the harm that results.

Other Important California Bike Laws

California has specific traffic rules for bicyclists, but these laws also clarify when cyclists are not required to ride at the far right and when drivers remain responsible for keeping them safe.

Counties and cities also have specific and unique laws about whether bikes are allowed to be ridden on sidewalks.

Although California law generally requires cyclists to ride in the same direction as motor vehicle traffic (California Vehicle Code Section 21650.1), motorists still owe cyclists the same duty of care as any other road user and must operate their vehicles safely at all times.

While cyclists riding more slowly than surrounding traffic should generally keep to the right, the law recognizes many situations where this isn’t safe or practical, as outlined in California Vehicle Code 21202. For example, a cyclist is fully permitted to take more of the lane when:

  • Passing another cyclist or vehicle;
  • Preparing for a left turn;
  • Avoiding hazards such as parked cars, debris, narrow lanes, or unsafe road conditions; or
  • Approaching an intersection where vehicles may turn right.

In addition, if a roadway is one-way with multiple lanes, cyclists may ride near the left curb if that is safer.

Who Is Liable in a Bike Accident In Los Angeles?

Los Angeles bicycle liability

Liability depends on fault. Numerous parties could be liable in a bike accident, including:

  • The driver of a motor vehicle.
  • The manufacturer of a motor vehicle or of a defective motor vehicle part.
  • A motor vehicle maintenance or repair business.
  • A bicycle maintenance or repair business.
  • A government entity responsible for dangerous or defectively designed roads or bike paths.
  • Another bicyclist or pedestrian.

At Panish | Shea | Ravipudi, LLP, our Orange County bicycle accident attorneys will scrutinize the details of your bicycle accident to help determine causation and liability. Most bicycle accident personal injury claims are based on negligence. To be successful in an Orange County bicycle accident negligence claim, you need to prove the existence of four elements:

  1. The defendant owed you a duty of care.
  2. The defendant breached that duty of care by their negligent actions or inactions.
  3. The defendant’s breach of duty was the cause of your accident.
  4. You suffered damages due to the defendant’s negligent action or inaction.

We use evidence to prove these elements of negligence. The type of evidence used varies depending on the facts of each accident. However, some evidence commonly used in an Orange County bicycle accident claim includes police accident reports, photographs from the accident scene, video footage from the accident scene, eyewitness accounts, medical records, medical and economic expert witness testimony and reports, and evidence of lost wages and financial losses incurred due to the accident and your injuries.

Unique Considerations for Bike Accidents in California

Bicyclists are in a vulnerable position on California’s roadways. They may not be immediately visible to drivers on the road, and many drivers are not accustomed to sharing the road with bikers. Bicyclists are also unprotected. They ride without the luxury of seatbelts, airbags, or other safety measures that can prevent injury. Though helmets can offer some protection, they do little to prevent head injuries in a motor vehicle accident. Speak to a brain injury attorney in Orange County today for more information.

California law requires motorists to share the road with bicyclists. Unfortunately, they do not always follow these rules, and bicyclists often sustain serious injuries. This rule, however, also gives cyclists some legal standing when seeking compensation for their injuries.

What is a Bicycle Accident Claim Worth?

Bicycle accident worth in Orange County

A bicycle accident can result in serious and sometimes permanent injuries. A crash can leave a victim with expensive medical bills, property damage, lost wages due to time away from work, psychological pain and suffering, and other losses. A victim can recover financial compensation from the at-fault party through a personal injury lawsuit. For example, if the accident was caused by a driver’s negligence or a defective bike component, a victim can recover damages from the driver or the manufacturer.

A bicycle accident claim can help a victim recover economic, non-economic, and sometimes punitive damages. Speak with the experienced Orange County accident lawyers with Panish | Shea | Ravipudi LLP to discuss how much your case is worth. If there is a death as a result of a bicycle accident, our Orange County wrongful death attorneys have your back. Call us today to schedule a free initial consultation.

What to Do After a Bike Accident in Orange County?

The hours, days, and weeks following a bike accident can be confusing. However, your actions are important to your personal injury case. Take the following steps after an accident:

  1. Ask to provide a statement for the police report. The CHP or local Orange County police will arrive on the scene of an accident to take pictures, get eyewitness statements, and conduct an investigation. Unfortunately, they likely will not ask for yours, as you’ll be on your way to the hospital for treatment. When you’re feeling up to it, call the police station and ask to provide a statement for the police report. This will make your version of events a matter of official record.
  2. Don’t sign anything from the insurance company. The driver’s insurance company may contact you and ask for a recorded statement or they might ask you to sign an offer. We strongly urge consulting with personal injury attorneys like Panish | Shea | Ravipudi LLP before signing any documents.
  3. Keep your doctor’s appointments. It’s essential to keep your appointments so you can heal and get back on your feet, but it may also have a bearing on your personal injury case. When deciding your “pain and suffering,” a jury might not look favorably on you missing doctor’s appointments.
