Rahul Ravipudi and Ian Samson obtained a $9,000,000 settlement in Clark County, Nevada for a young woman injured when her vehicle was struck by a Garda armored truck. With trial set for January 2025, PSR joined the case in September 2024 and immediately demanded full disclosure of all insurance policies, as required under Nevada law. This revealed that more than $67 million in coverage had been withheld for years.
PSR then moved for sanctions, leading the Court to hold three sanctions hearings, including two evidentiary hearings where Ian Samson cross-examined Garda’s general counsel. The Court ultimately found that Garda and its attorneys at Lewis Brisbois Bisgaard & Smith LLP had willfully concealed the additional insurance, causing prejudice to the Plaintiff. On the eve of jury selection, the Court imposed case-terminating sanctions and set the matter for a default prove-up. The settlement was reached two days later.
This outcome was both a hard-earned victory for our client and a strong warning to defendants in Nevada and beyond: follow the rules and fully disclose insurance coverage, or face serious consequences. Since the ruling, PSR has heard from litigants nationwide that the “Miller order” is being cited to compel defendants to produce additional insurance information.
