California Girl Scouts Sexual Abuse Lawyers
Request Free ConsultationGirl Scouts is meant to be a place where girls build confidence under the guidance of trusted adults. When a troop leader, volunteer, or camp staff member violates that trust, survivors and their families deserve answers, including whether the organization properly vetted the individual or knew of earlier complaints. The California child sexual abuse attorneys at Panish | Shea | Ravipudi LLP help survivors seek justice from those responsible, both the individual and the institutions that failed to protect them.
The Advantage of Having Panish | Shea | Ravipudi LLP in Your Corner
Claims involving Girl Scouts programs may extend beyond an individual troop to a local council and, in some cases, the national organization, depending on the facts. Going up against these entities requires skill and experience, which is what we bring to the table.
- We have more than forty attorneys across four offices, with lawyers licensed in eight states and the District of Columbia, handling cases throughout the United States.
- A “Tier 1” ranking from Best Lawyers® for Plaintiffs Personal Injury Litigation and recognition from the National Law Journal as one of the nation’s top 12 plaintiff’s firms.
- Because we limit how many cases we accept, your case will always get the attention it deserves.
Survivors bringing claims against a national organization shouldn’t have to accept a mismatch in resources or reach. With our firm, they don’t. We are always prepared to take on these large entities.
How Long Do You Have to File a Girl Scouts Abuse Claim in California?
California has repeatedly extended its filing deadlines for childhood sexual abuse, and the current rules are far more generous than most survivors assume. The answer depends primarily on when the abuse occurred.
For abuse that happened before January 1, 2024, California Code of Civil Procedure section 340.1 gives a survivor until their 40th birthday, or up to five years after realizing as an adult that their psychological injuries were caused by the abuse, whichever date is later, to file a lawsuit.
For abuse that occurred on or after January 1, 2024, California’s law has changed, and there is now generally no statute of limitations for filing a civil claim related to childhood sexual assault.
What no longer exists is the three-year “revival window” created by AB 218, which allowed previously expired claims to be filed and closed at the end of 2022.
Survivors whose claims fall outside the current rules should not assume the door is shut, though. The discovery rule, the date-of-accrual analysis, and the specific facts of each case can change the answer. Deadline questions in this area are genuinely technical, and you should always speak with a lawyer to figure out if you’re within the deadline or not.
What Evidence Supports a Claim Against a Scouting Organization?
Survivors often worry that their word is all they have, especially when the abuse happened years or decades ago. In practice, claims against scouting organizations rest on far more than a single account. Evidence often includes:
- Council correspondence, meeting minutes, and internal complaint files can reveal earlier reports about the same individual, and how the organization responded.
- Camp rosters, troop records, event registrations, and photographs corroborate that the survivor and the abuser were where the survivor says they were, when they say they were.
- Other troop members, their parents, and former volunteers frequently remember more than you’d expect, and may have witnessed warning signs or heard complaints at the time.
An experienced California Girl Scouts sexual abuse attorney can identify what records may exist, determine who controls them, and take the legal steps necessary to obtain them. Always reach out for help.
Why Taking On a National Organization Alone is Risky
A claim involving abuse in Girl Scouts programs raises the question of liability, which might sound simple, but it’s far from it. The national organization, the regional council, and the individual troop are separate entities with separate insurance, and each may try to argue that the other one is responsible – or that no one is responsible. A sexual abuse lawyer can help in the following ways:
- Determining which entity screened, supervised, and insured the individual responsible.
- Compelling and subpoenaing records and internal correspondence that organizations do not disclose voluntarily.
- Applying California’s statute of limitations rules correctly, including the extended filing periods for childhood sexual assault claims.
National organizations litigate these cases with coordinated defense strategies refined over many claims. An experienced Girl Scout sexual abuse attorney can help you level the playing field and give you a chance of getting what you’re owed.
